The British antitrust watchdog, the Competition and Markets Authority (CMA), has officially launched a formal investigation into Microsoft, centering on allegations that the tech giant misled personal and family subscribers regarding its Microsoft 365 plans. According to the regulatory body, the core of the concern lies in the marketing strategies employed by Microsoft when integrating its artificial intelligence assistant, Copilot, into existing subscription tiers. This probe seeks to determine whether the company engaged in deceptive practices that may have ultimately forced or coerced consumers into paying higher prices for services they may not have fully understood or intended to purchase.

The focus of the CMA’s inquiry pertains to the transition period during which the AI-powered Copilot feature was introduced to the consumer market. Initially, Microsoft offered this advanced tool at no additional charge to personal and family users. However, as these subscription cycles reached their renewal dates, many customers reportedly found themselves migrated to more expensive plans that included the Copilot suite. The regulator is now tasked with investigating whether Microsoft failed to provide sufficient, transparent notice to its users regarding the price hikes and whether customers were adequately informed that they had alternatives available during the renewal process.

In an official statement released this week, the CMA emphasized that while it remains broadly supportive of the rapid adoption and integration of AI across the United Kingdom’s digital ecosystem, such technological advancements cannot come at the expense of consumer rights. The agency stressed a position that clear, timely, and accessible information must be a baseline requirement for any company operating in the subscription software space. By failing to disclose the exact nature of the cost differences or the potential for automatic price increases, regulators fear that Microsoft may have obscured the options available to customers, thereby preventing them from making informed financial decisions.

Microsoft has responded to the initiation of the probe by stating that it is currently reviewing the CMA’s claims with the level of scrutiny required for such a high-profile legal matter. A spokesperson for the Redmond-based software giant assured the public that the firm remains committed to working constructively with the UK regulator throughout the duration of the investigation. Despite this conciliatory tone, Microsoft faces a significant bureaucratic hurdle as it attempts to justify its marketing and renewal practices, which have now come under intense national and international scrutiny.

This investigation contributes to a growing pattern of regulatory challenges for Microsoft on a global scale, as the company faces mounting scrutiny over its dominance in business software, cloud computing, and AI partnerships. In May, the CMA already launched a separate inquiry into Microsoft’s overall market power within the business software sector. The current probe into Microsoft 365 adds to an increasingly complex litigation landscape for the corporation, which remains one of the primary targets for antitrust scrutiny as governments attempt to restrain the influence of “Big Tech” in the era of generative AI.

The scope of this issue extends well beyond the borders of the United Kingdom, as the CMA noted that similar regulatory bodies in Australia and Italy have also initiated probes into Microsoft’s subscription practices. These international investigations mirror the concerns cited by the British watchdog: specifically, the adequacy of the information provided to consumers when their software contracts reach their expiration or renewal points. As these global authorities share evidence and coordinate efforts, Microsoft faces the prospect of either adjusting its global subscription models to meet heightened transparency standards or risking significant financial penalties and legal injunctions.
