The race for Indiana’s Senate District 23 seat has become a center of intense scrutiny following a razor-thin victory in the May Republican primary. Incumbent Sen. Spencer Deery, R-Lafayette, emerged with a win over challenger Paula Copenhaver by a margin of just three votes out of more than 12,000 ballots cast. Following the certification of these results, Copenhaver filed for a formal recount, specifically challenging the validity of a single absentee ballot that was added to Deery’s total the morning after primary election day.
The dispute reached the Indiana Recount Commission on July 28, where Copenhaver’s legal counsel, William Bock III, sought to compel discovery. Bock requested subpoenas for electoral documents from the Tippecanoe County Clerk’s Office and the local Board of Elections, as well as permission to depose County Clerk Julie Roush. Copenhaver’s legal team argued that the “after-the-fact” addition of the ballot warranted an investigation into chain-of-custody procedures, alleging that the ballot might have been left unsecured and processed without proper bipartisan oversight.
Despite the arguments presented by the challenger, the Indiana Recount Commission unanimously denied all three motions for discovery without providing a public rationale for their decision. Meanwhile, the legal counsel for Sen. Deery, Samantha DeWester, emphasized that the official recount process resulted in no changes to the initial outcome, leaving Deery’s victory intact. DeWester characterized Copenhaver’s legal efforts as an attempt to “go in search of other things” to overturn a certified result that had already been verified by the recount process.
In the wake of the commission’s decision, Clerk Julie Roush issued a sharp public rebuke of Copenhaver’s claims. During a meeting of the Tippecanoe County Election Board on July 29, Roush read a prepared statement detailing the strict transparency protocols observed by her office. She explicitly denied Copenhaver’s allegations that the ballot had been handled improperly or processed without oversight, noting that she had recused herself from the ballot-tabulation process entirely due to her own concurrent candidacy for county office.
Roush provided a detailed account of the ballot’s journey, asserting that the envelope was never unsecured and remained under the constant supervision of a bipartisan team and law enforcement. According to the clerk, the ballots were transported to the election board office, verified for signatures, and locked in a secure area under 24-hour video surveillance. She maintained that every step of the process adhered to Indiana law and argued that the candidate’s claims were not only inaccurate but damaging to public trust in the state’s electoral institutions.
The controversy highlights the persistent divide between candidates seeking to investigate procedural technicalities and election officials striving to defend the integrity of their staff. While Copenhaver’s team insists that the public is entitled to a clear explanation of how the contested vote was added, local authorities have moved to close the matter, framing the incident as a perfectly lawful procedure that has been unfairly characterized as a controversy. As of now, the recount remains concluded with Deery’s three-vote lead standing as the final, certified result.
