UN Report Urges Criminalization of Climate Disinformation and Fossil Fuel Lobbying

A groundbreaking report presented to the United Nations General Assembly by Special Rapporteur Elisa Morgera calls for drastic measures to combat the climate crisis, including the criminalization of climate disinformation and a complete ban on fossil fuel lobbying and advertising. The report, titled “The Imperative of Defossilizing Our Economies,” underscores the urgent need for a rapid transition away from fossil fuels to protect human rights and address the escalating climate emergency. Morgera argues that wealthy, fossil fuel-dependent nations have a legal obligation under international law to phase out these harmful energy sources by the end of the decade and provide compensation to communities impacted by their extraction and use.

The report emphasizes the overwhelming scientific consensus linking fossil fuels to climate change and other planetary crises, including biodiversity loss, pollution, and social inequalities. Morgera, a professor of environmental law, advocates for a comprehensive ban on fossil fuel exploration, investments, and subsidies, as well as harmful practices like gas flaring, fracking, and reliance on unproven technological solutions. She points to the enormous profits accrued by fossil fuel companies, particularly in countries like the United States, Canada, Australia, and the United Kingdom, while these nations fail to take decisive action to mitigate the climate crisis. The report highlights the disproportionate impact of fossil fuel extraction and climate change on vulnerable communities, such as Indigenous Peoples and island nations, who bear the brunt of the consequences while benefiting the least from the industry’s profits.

The report meticulously documents the extensive human rights violations associated with the fossil fuel lifecycle, impacting rights to life, health, food, water, housing, education, livelihoods, information, and self-determination. Despite growing awareness of these impacts and the increasing feasibility of renewable energy sources, fossil fuel extraction and use are projected to rise, undermining global efforts to decarbonize. Morgera argues that a complete “defossilization” of economies is essential, extending beyond the energy sector to encompass finance, food, technology, politics, and media. This comprehensive approach aims to address the pervasive influence of fossil fuels and their detrimental effects on all aspects of society.

A key aspect of the report focuses on the deliberate dissemination of disinformation by the fossil fuel industry and its allies. Morgera emphasizes the right of citizens to be informed about the harms of fossil fuels and the industry’s documented history of obstructing climate action through misinformation campaigns, attacks on climate activists and scientists, and undue influence on political processes, including UN climate conventions. This “playbook” of deception has undermined public understanding of the climate crisis and hampered efforts to address it for decades. The report advocates for a ban on fossil fuel lobbying and advertising, criminalization of greenwashing, and stricter penalties for attacks on climate advocates to counter this disinformation campaign.

The report also tackles the economic injustices associated with the fossil fuel industry. While communities suffer the consequences of climate change, including drought, desertification, sea-level rise, flooding, and displacement, fossil fuel companies continue to amass enormous profits, often benefiting from tax loopholes, government subsidies, and international investment laws that shield them from accountability. These profits come at the expense of addressing economic inequalities and reducing energy poverty, further exacerbating existing social disparities. The report estimates that eliminating fossil fuel subsidies alone could reduce global emissions by up to 10% by 2030. Morgera calls for the remediation and return of unjustly appropriated lands to their rightful owners, along with fair compensation for the damages caused by fossil fuel operations.

In essence, the report frames the climate crisis as a human rights issue, urging decisive political action to prioritize the well-being of people over the profits of a few. Morgera contends that the transition to a renewable energy-based economy, while seemingly radical, is not only economically viable but also essential for protecting human health and the planet’s future. The report challenges the narrative perpetuated by the fossil fuel industry that portrays this transition as unrealistic, arguing that the industry’s deliberate misinformation and obstruction have created a false perception of the feasibility and necessity of renewable energy. By exposing these tactics and advocating for bold policy changes, including criminalizing disinformation and banning fossil fuel lobbying, the report aims to pave the way for a just and sustainable future. It emphasizes that the transition to renewable energy can generate significant cost savings by reducing climate change impacts, healthcare expenses, and recouping lost tax revenue from fossil fuel companies, ultimately representing a crucial investment in global health and well-being.
