UN Expert Calls for Criminalization of Fossil Fuel Disinformation and Ban on Related Lobbying

UN Expert Demands Criminalization of Climate Disinformation and Fossil Fuel Industry Overhaul

A groundbreaking report by UN Special Rapporteur Elisa Morgera calls for a radical transformation of the global approach to climate change, advocating for criminal penalties against purveyors of climate disinformation and a complete ban on fossil fuel lobbying and advertising. The report, presented to the UN General Assembly in Geneva, asserts that wealthy fossil fuel nations have a legal obligation under international law to eliminate oil, gas, and coal by 2030 while compensating communities harmed by these industries.

Morgera’s report highlights the devastating impact of the fossil fuel industry on human rights, citing extensive evidence linking oil, gas, coal, fertilizers, and plastics to violations of rights to life, health, food, water, housing, and more. She argues that a mere transition to clean energy is insufficient; rather, a comprehensive "defossilization" of entire economies, including politics, finance, media, and technology, is necessary. This entails eradicating the influence of fossil fuels across all sectors. Morgera contends that the industry’s persistent obstruction of climate action, through disinformation campaigns and attacks on scientists and activists, has systematically undermined the protection of human rights.

The report emphasizes the disproportionate burden borne by vulnerable communities – island nations, Indigenous populations, and others – who have contributed least to the problem but face the worst consequences of climate change. These include rising sea levels, desertification, extreme heat, floods, and displacement, in addition to the pollution and health hazards associated with fossil fuel extraction and use. Meanwhile, the industry continues to reap enormous profits, benefiting from subsidies, tax avoidance schemes, and legal protections, all while failing to address energy poverty or economic inequalities.

Morgera’s recommendations include banning fossil fuel advertising and lobbying, criminalizing greenwashing, and imposing severe penalties for attacks on climate advocates. She also calls for redirecting fossil fuel subsidies, estimated at over $1.4 trillion in 2023, towards assisting developing countries in their transition to clean energy and providing financial remedies for the human rights violations and environmental damage caused by fossil fuel industries.

The report proposes compelling mechanisms for funding compensation, including penalties for industry-caused damages, cracking down on tax evasion, and implementing wealth and windfall taxes. It suggests that fossil fuel companies should finance climate adaptation, mitigation, and loss and damage through dedicated funds directly accessible to affected communities. Furthermore, it advocates for the return of unjustly appropriated land to Indigenous and other communities or the provision of fair compensation.

Morgera’s recommendations represent a paradigm shift in addressing the climate crisis, prioritizing human rights over corporate profits and demanding accountability from those who have perpetuated the problem. While some may view these proposals as radical, she argues that they are not only necessary but also economically and socially beneficial in the long run. The transition to a renewable energy-based economy, while seemingly ambitious, is ultimately more cost-effective and healthier for societies, offering significant savings in healthcare costs and potentially recouping lost tax revenue. Morgera emphasizes that the perceived radicalism of the transition is largely a product of successful manipulation by the fossil fuel industry.

Morgera’s report is a clarion call for a global reckoning with the fossil fuel industry’s role in the climate crisis and a radical reorientation towards a just and sustainable future. It challenges conventional wisdom, confronts powerful interests, and champions the rights of the most vulnerable in the face of a planetary emergency. The international community now faces a critical choice: to heed this urgent call for transformative action or continue down a path of escalating climate chaos and human rights violations. The report’s recommendations, while seemingly drastic, offer a roadmap for a future where human rights and environmental protection prevail over corporate greed and unchecked exploitation of fossil fuels. It remains to be seen whether governments and international bodies will muster the political will to embrace this profound and necessary change.
