Karnataka Proposes Stringent Measures to Combat Fake News and Misinformation
Bengaluru – The Karnataka government is taking decisive action against the proliferation of fake news and misinformation by introducing the Karnataka Misinformation and Fake News (Prohibition) Bill, 2025. This proposed legislation outlines stringent penalties, including imprisonment of up to seven years and fines up to ₹10 lakh, for individuals found guilty of disseminating fake news on social media platforms. The bill also targets misinformation in publications, prescribing a jail term of two to five years along with fines. Notably, these offenses are categorized as cognisable but non-bailable.
Central to the government’s strategy is the formation of a six-member social media regulatory authority. This body will be responsible for scrutinizing online content, ensuring that information shared on social media platforms is grounded in credible research across diverse fields such as science, history, religion, philosophy, and literature. The authority will also play a crucial role in preventing the spread of content deemed insulting to women or disrespectful to Sanatana Dharma, its symbols, and beliefs, as well as content promoting superstition.
The proposed legislation emphasizes accountability by outlining the establishment of dedicated special courts, in concurrence with the Karnataka High Court, to handle cases related to misinformation and fake news. Presided over by a sessions judge, these courts will have the jurisdiction to issue directives to intermediaries, publishers, broadcasters, and anyone controlling communication mediums disseminating misinformation within Karnataka. Non-compliance with court orders will result in further penalties, including potential imprisonment of up to two years and daily fines of ₹25,000, capped at a maximum of ₹25 lakh.
Recognizing the role of corporate entities in the dissemination of misinformation, the bill extends accountability to company directors and employees present during any violation of the law. This provision aims to deter corporate negligence and ensure responsible content management practices. Aggrieved parties will be granted a 30-day window to respond to notices issued by the special courts, ensuring due process.
