Exposing the Disinformation Campaign of the Plastics Industry in Defense of PFAS

The Forever Chemicals Deception: How the Plastics Industry is Undermining Efforts to Ban PFAS

Per- and polyfluoroalkyl substances (PFAS), dubbed "forever chemicals," are pervasive, persistent pollutants contaminating every corner of our planet and every living being. These chemicals, manufactured for decades by a handful of companies, don’t break down in the environment, accumulating in water, soil, and even our bloodstreams. The potential health consequences are dire, ranging from cancer and immune dysfunction to hormonal disruption. Despite the overwhelming scientific consensus on the dangers of PFAS, a powerful lobbying effort by the plastics industry and other PFAS users is working tirelessly to weaken proposed regulations aimed at banning these harmful substances.

In 2023, five European countries proposed a comprehensive ban on over 10,000 PFAS chemicals under the EU’s REACH regulation. This bold move triggered an unprecedented lobbying campaign, with industry representatives flooding EU institutions with arguments intended to undermine the proposal. The Forever Lobbying Project, an investigative collaboration, has meticulously analyzed these lobbying arguments, revealing a pattern of misleading, fearmongering, and potentially dishonest tactics straight out of the corporate disinformation playbook.

The investigation, which analyzed over 8,000 documents obtained through Freedom of Information requests and public submissions, focused on the lobbying efforts surrounding fluoropolymers, a lucrative class of "high-performance" plastics used in countless applications. The industry, led by Plastics Europe and its Fluoropolymer Product Group (FPG), has deployed a range of scientific and economic arguments to secure exemptions for these chemicals. However, a rigorous stress test of these arguments, conducted in collaboration with a corporate harm researcher, exposed their deceptive nature.

One of the industry’s central claims is that fluoropolymers are "Polymers of Low Concern" (PLC) and therefore pose minimal risk. This argument relies heavily on two scientific articles authored by industry employees or consultants. The OECD, however, has explicitly confirmed that no such "PLC criteria" exist and that it has not conducted any assessment of fluoropolymers. This blatant misrepresentation of scientific findings is a prime example of the industry’s deceptive tactics.

Furthermore, the industry argues that PFAS emissions can be effectively managed and that existing regulations are sufficient. This claim is contradicted by scientific evidence demonstrating that even reduced emissions still pose a threat and that the complete destruction of PFAS waste requires extremely high temperatures not achievable by standard incineration methods. The industry’s assertion that they’ve developed “clean” manufacturing processes using non-PFAS ingredients is also misleading, as PFAS by-products can still be formed during production.

Beyond the manipulation of scientific data, the plastics industry employs a "there is no alternative" narrative to stall regulation. This argument, often used effectively with policymakers, emphasizes the supposed irreplaceability of fluoropolymers in critical applications like medical devices, semiconductors, and green technologies. However, an independent analysis revealed potential alternatives for a significant portion of these applications, highlighting the industry’s lack of genuine effort to explore alternatives. The industry’s claims about the devastating economic consequences of a PFAS ban also appear inflated and rely on questionable assumptions, echoing similar exaggerated predictions made during previous regulatory efforts.

The Forever Lobbying Project’s investigation unveils a concerted effort by the plastics industry to obstruct meaningful action on PFAS. By employing tactics of disinformation, downplaying the risks, and exaggerating the economic consequences of regulation, the industry is prioritizing profits over public health and environmental protection. The investigation underscores the urgent need for policymakers to resist these deceptive lobbying efforts and implement comprehensive restrictions on PFAS to protect human health and the environment from these persistent and harmful chemicals. The documented evidence suggests a decades-long pattern of delaying tactics, mirroring the strategies employed by industries like tobacco and fossil fuels. The fight against PFAS pollution necessitates a clear-eyed understanding of these tactics and a commitment to science-based policymaking. The future of our planet and the well-being of future generations depend on it.
