China Requires Labeling of All AI-Generated Content to Combat Misinformation and Fraud

China Unveils Comprehensive Regulations for AI-Generated Content, Emphasizing Transparency and Combating Misinformation

Beijing – In a significant move to regulate the rapidly evolving landscape of artificial intelligence, China’s Cyberspace Administration of China (CAC), in collaboration with the Ministry of Industry and Information Technology, the Ministry of Public Security, and the National Radio and Television Administration, has announced sweeping new regulations governing AI-generated content. Effective September 1, 2024, these regulations mandate clear identification of all AI-generated content, encompassing text, images, audio, video, and virtual realities, aiming to bolster online transparency and combat the proliferation of misinformation in the digital realm. This decisive action underscores China’s commitment to responsible AI development while navigating the complexities of this transformative technology.

The regulations stipulate a dual-pronged approach to content labeling: explicit and implicit. Explicit markers, designed for immediate user recognition, must be prominently displayed alongside AI-generated content. This ensures users are readily aware of the content’s origin and can critically evaluate its authenticity. Concurrently, implicit identifiers, such as digital watermarks embedded within the metadata, will provide a more technical means of verification. This layered approach reinforces transparency and accountability within the AI content ecosystem. Providers are obligated to implement these labeling mechanisms diligently, ensuring that users are equipped with the necessary information to assess the content they encounter online.

The new regulations place a significant onus on online service providers involved in AI content generation. These providers are mandated to verify the nature of AI-generated content before disseminating it online and apply the required labels diligently. This proactive approach aims to prevent the inadvertent spread of misinformation and maintain a cohesive online environment. Furthermore, if metadata lacks AI markers but the content exhibits characteristics indicative of AI generation, platforms are obligated to flag such instances, further reinforcing the commitment to transparency. App distribution platforms also play a crucial role in this regulatory framework, as they must thoroughly assess AI-related functionalities before granting approval for service deployment.

The move comes as China witnesses a surge in AI development and adoption across various sectors. Recognizing the potential for misuse and the propagation of fabricated content, these regulations are aimed at preemptively addressing challenges posed by AI-generated misinformation. By requiring clear labeling, authorities aim to empower users to discern between human-created and AI-generated content, fostering a more informed and responsible online environment.
