EU Strengthens Disinformation Fight with Enhanced Code of Practice Integration into Digital Services Act

BRUSSELS – The European Union is bolstering its efforts to combat the pervasive threat of online disinformation by formally integrating its Code of Practice on Disinformation into the Digital Services Act (DSA), the bloc’s comprehensive framework for regulating online platforms. This move aims to solidify the voluntary commitments made by signatory platforms, providing a clear roadmap for mitigating the spread of harmful false information and holding platforms accountable for their role in the online information ecosystem. The integration, set to take effect on July 1, 2025, will transform the Code’s recommendations into auditable obligations, strengthening the EU’s stance against disinformation and providing a firmer legal basis for enforcement.

The Code of Practice, a voluntary framework established in 2018, outlines a series of commitments for online platforms to address disinformation. These commitments include reducing financial incentives for disseminators of disinformation, enhancing service integrity by tackling fake accounts and bots, and supporting independent fact-checking initiatives. While initially voluntary, the integration into the DSA will make these commitments legally binding for signatory platforms, signaling a significant shift in the EU’s approach to online content moderation and emphasizing the importance of platform accountability in combating disinformation.

This integration comes at a crucial time as the EU faces increasing challenges in regulating the spread of disinformation across digital platforms. The departure of Elon Musk’s X (formerly Twitter) from the Code in 2023, along with Meta’s recent withdrawal from its fact-checking commitment, underscores the difficulties the bloc faces in enforcing its vision for a safer online space. These actions highlight the tension between platform autonomy and regulatory oversight, with some platforms expressing resistance to what they perceive as excessive interference.

The DSA’s integration with the Code of Practice aims to address this tension by providing a clear framework for platform accountability while also offering a pathway for compliance. By outlining specific measures, such as tackling inauthentic behavior and promoting media literacy, the DSA empowers platforms to take proactive steps against disinformation, moving beyond a reactive approach. The auditable nature of the commitments will further enhance accountability, providing a mechanism for assessing platform compliance and ensuring consistent enforcement of the rules.

However, the EU’s path to a disinformation-free online environment remains fraught with challenges. The upcoming enforcement date of July 1, 2025, leaves a substantial window for platforms to adapt, raising concerns about continued inaction in the interim. The ongoing DSA investigation into X, initiated in December 2023, further complicates matters, highlighting the difficulties in effectively regulating platforms that operate across national borders and often push back against regulatory oversight. The success of the integrated Code will depend on the EU’s ability to effectively enforce its provisions and navigate the complex interplay between platform autonomy and public interest.

The integration of the Code of Practice into the DSA represents a significant step forward in the EU’s fight against online disinformation. By transforming voluntary commitments into legally binding obligations, the EU seeks to establish a clearer framework for platform accountability and bolster its efforts to protect the integrity of the online information ecosystem. The upcoming months will be crucial in observing how this integration plays out, particularly in light of the challenges posed by platform resistance and the ongoing DSA investigations. The success of this initiative will ultimately depend on the EU’s capacity to effectively enforce its regulations and foster a collaborative approach with online platforms to create a safer and more trustworthy online environment for all.
